Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Bobo Marketplace (“Bobo”, “we”, “us”) governing access to and use of https://assets.itsindianguy.in and related services (collectively, the “Service”). By creating an account, browsing, purchasing, downloading, uploading, or otherwise using the Service, you agree to these Terms, our Privacy Policy, Refund Policy, and Data Safety practices. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract under applicable law. You are responsible for accurate registration information, safeguarding login credentials, and all activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms, create risk, or remain inactive for extended periods.

2. The marketplace

Bobo offers Free, Premium, and Exclusive digital assets. Free assets may require sign-in. Premium assets are included with an active Premium plan. Exclusive assets require a separate purchase and are not included in Premium. Listings may change; we try to keep metadata accurate but do not guarantee uninterrupted availability of any particular file. Asset licenses (personal, commercial, extended, editorial, or as stated on the listing) control how you may use downloaded files. Always read the license on the asset page before purchase or download.

3. Purchases, Premium, and taxes

Prices are shown in the currency displayed at checkout (typically INR when using Razorpay). Payment is processed by third-party providers. By completing checkout you authorize the charge for the selected item(s) or subscription period. Premium grants time-limited access as described on the pricing page; unless stated otherwise, renewals or extensions follow the product description at purchase. You are responsible for applicable taxes. Digital goods are generally delivered immediately via download entitlement after successful payment confirmation.

4. License grant to buyers

Upon successful purchase or entitled Premium/Free download, we grant you a non-exclusive, non-transferable, worldwide license to use the asset solely within the scope of the license type shown on that listing. You may not: resell or redistribute the raw asset as a competing stock product; claim authorship of AI-generated content in a misleading way; remove required notices; or use assets for unlawful, defamatory, or infringing purposes. Ownership of underlying intellectual property remains with Bobo, the uploading creator, or respective rights holders as applicable. AI-generated works may have limited or uncertain copyright status under local law; the license we grant is contractual permission to use the file under stated terms.

5. Creator uploads and representations

If you upload assets, you represent that you have all rights needed to license them through Bobo, that content does not infringe third-party rights, and that you have disclosed AI generation where required by law or platform rules. You grant Bobo a worldwide license to host, preview, market, and deliver your assets to buyers according to the licenses you select. We may remove or refuse content that is illegal, deceptive, spammy, unsafe, sexually exploitative of minors, or otherwise harmful. Revenue shares, if any, are governed by separate creator program terms we publish in the dashboard.

6. Acceptable use

• Do not scrape, bulk-download, or reverse engineer the Service beyond ordinary browser use.
• Do not bypass paywalls, Premium checks, or Exclusive purchase gates.
• Do not upload malware, phishing content, or illegal material.
• Do not harass users or abuse reviews/comments.
• Do not interfere with security, rate limits, or infrastructure.

7. Intellectual property of the Service

The Bobo name, logos, site design, software, and original non-user content are protected by intellectual property laws. You may not copy the platform, brand marks, or proprietary UI except as needed to use the Service. Feedback you submit may be used freely to improve Bobo without obligation to you.

8. Disclaimers

THE SERVICE AND ASSETS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that downloads will be error-free, that AI outputs will meet every creative brief, or that the Service will be uninterrupted. Some jurisdictions do not allow certain disclaimers; in those places, warranties are limited to the minimum extent permitted by law.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOBO AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO BOBO FOR THE TRANSACTION GIVING RISE TO THE CLAIM IN THE THREE MONTHS BEFORE THE EVENT, OR (B) INR 5,000. These limits apply even if a remedy fails its essential purpose.

10. Indemnity

You agree to defend and indemnify Bobo against claims arising from your misuse of assets, your uploads, your breach of these Terms, or your violation of law or third-party rights.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, legal risk, or operational reasons. Provisions that by nature should survive (licenses already granted subject to their terms, payment obligations, disclaimers, liability limits, indemnity) will survive termination.

12. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India shall have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived. Before filing a claim, contact support@bobomarketplace.com so we can try to resolve the issue informally.

13. Changes

We may update these Terms by posting a revised version with a new “Last updated” date. Material changes may be highlighted on the site. Continued use after changes take effect means you accept the revised Terms.
